What can I do? I feel like I’m stuck.: I was rear ended and the 2 other cars involved don’t want to pay for the damages to my car. I got in contact with the guy that hit the lady behind me (who ended up hitting me) and he keeps saying he’s gonna pay for the damages but has been avoiding it for 2 months already. The lady’s insurance said they’re not going to pay for anything because the guy was at fault, I called his insurance and they said he’s not even on the insurance, and my insurance said they can’t do anything about it. At the moment of the accident I didn’t feel pain but later on that day I had bad pain on my neck, I was stubborn so I didn’t see no doctor and right now I’m at the point where if I put my head down for a bit my neck will start hurting bad.
David’s answer: Step 1: get medical care. Step 2: get a lawyer. You have a complicated case and there’s just no way you’ll be able to handle it yourself. Many lawyers will help with getting your car repaired as part of pursuing a claim for personal injury damages, so make sure to get a lawyer that will do that for you.
Do police officers have to buckle you up after being arrested and placed in the back of the car?: Recently arrested and the officer failed to buckle me in. Had to tell him he failed to do so after driving for about a minute. Was just curious if this is actually lawful? Thanks.
David’s answer: It is not illegal but it is against most police departments’ policies and procedures.
Defaulted judgement. I was never served the documents and only knew of it when I ran my credit report: I was in a car accident about 1 1/2 year ago. It was a minor accident and insurance company already paid out the repair of the car. Today, I tried to retrieve my credit report and found that I defaulted on the PI case. The case was filed about year ago and I was never served the documents as I have moved since then. What should be my next steps?
David’s answer: If you were insured when the accident occurred, advise your insurance company of the situation and ask them to do whatever it takes to vacate the judgment and reopen the case.
If you were not insured you will need to hire a lawyer to do that work for you.
